Koskie Minsky’s Pension and Benefits Litigation and Regulatory Proceedings Group has an established reputation across North America as a leader in disputes pertaining to pensions and benefits. We have been involved in significant Canadian cases, and continue to represent clients in contentious matters pertaining to the security of pension and benefit fund assets.
Our Group practitioners represent trade unions, pension funds, employees and retirees. We advise pension fund administrators on difficult trust, pension and benefit law issues, and bring applications to court for direction. Our services include the litigation of disputes before courts, tribunals and arbitrators, and the resolution of disputes through negotiation, mediation and alternative dispute resolution. We provide counsel for taxation matters in the employee benefits field. We supply extensive legal opinion services to parties that need to clarify their position or entitlements.
Our experience as counsel in pension and benefits disputes extends to numerous trial courts, commissions and tribunals across Canada. We have been involved in pension and benefits cases before all levels of courts, including the Supreme Court of Canada, the Federal Court of Appeal, and the Ontario Court of Appeal. Our firm has been prominent in the representation of clients at hearings before the Financial Services Appeal Tribunal (formerly the Pension Commission of Ontario) and various Canadian Superintendents.
We also assume a prominent advocacy role where we have appeared as counsel on leading decisions in this field, i.e., pension surplus, pension insolvency, class action suits, and advocating the rights of individuals, spouses and same-sex partners.
