Internal Union Affairs
Our Labour Lawyers regularly and routinely advise clients about internal union affairs and governance. This ranges from drafting and interpreting constitutions and by-laws to providing advice regarding election and nomination procedures. We assist clients with respect to a broad range of internal union affairs, including fair and effective discipline procedures. We also have experience in challenging such procedures on behalf of our clients.
We advise clients of their obligations under the common law and relevant legislation governing internal union affairs, including statutory disclosure requirements and the duty to fairly represent or refer members. We also represent clients in any tribunal or court proceeding arising from these obligations.
