Koskie Minsky Appointed Representative Counsel In HBC Pension Plan and Dumai Pension Plan Surplus Mediation

Koskie Minsky LLP is pleased to announce that, on June 26, 2026, the Ontario Superior Court of Justice appointed the firm as Representative Counsel for the members of the Dumai Pension Plan (formerly the Simpsons Pension Plan) in a court-ordered mediation concerning entitlement to the pension plan surplus following the wind up of the Hudson’s Bay Company Pension Plan.
The Court also appointed the Honourable Geoffrey Morawetz, recently retired Chief Justice of the Ontario Superior Court of Justice, as mediator.
The mediation follows the wind up of the HBC Pension Plan, which is reported to have a surplus of approximately $172.9 million. There are competing claims to those surplus funds, including claims by HBC, its secured lenders, and Dumai Plan members. Koskie Minsky has long represented Dumai Plan members, including in the landmark Sutherland v. Hudson’s Bay Company litigation, where the courts recognized their entitlement to the Dumai Plan surplus on wind up.
The mediation process has now commenced, beginning with a 60-day negotiation period before the mediator becomes actively involved.
