We represented 11 union locals in Ontario and Alberta in this volatile CCAA proceeding. We persuaded the court to order that unpaid wages be paid ahead of the claims of DIP Lender, and participated in the approval of an arrangement that preserved 1000 jobs nationwide. We obtained an order under section 36(7) of the CCAA requiring that terminated union employees be paid their outstanding wages from the sale proceeds of Comstock. We also negotiated recognition agreements with the successor company for the unionized employees in Ontario. Demetrios Yiokaris led the Koskie Minsky team, which included Adrian Scotchmer and James Harnum.
