The Plaintiffs will be moving for summary judgement on Common Issues (a) and (c), as specified in the Certification Order of Justice Phelan dated June 7, 2021.
The Plaintiffs will argue that Canada owed a duty to take reasonable steps to prevent all Métis and Non-Status children who were placed in the care of non-Indigenous foster or adoptive parents, from losing their Indigenous identities.
Canada has informed the Plaintiffs that it will be moving for summary judgment on the limitations period issue. Canada’s record for summary judgment is due June 30, 2024.

Both motions for summary judgment (Duty of Care and Limitations Period) will be heard before Justice Sébastien Grammond on December 9-12, 2024. A copy of the court’s decision will be posted here when it is available.
