Youth Confinement Class Action – March 14, 2023

Justice Perell of the Ontario Superior Court of Justice has ruled in favour of the Plaintiff and the Class Members following a dispute with the Government of Ontario concerning the interpretation of the Settlement Agreement. Justice Perell’s decision means that the Claims Administrator and Claims Adjudicator will award compensation to a Claimant for all placements that are documented in the Claimant’s Youth Records and that meet the criteria in the Settlement Agreement, regardless of whether the Claimant has referred to all placements on his or her Claim Form.

We are pleased with this result and will continue to advocate for the Class Members and Claimants in this action.
