The Federal Court hearing took place on December 9-11, 2024. The Court heard the Plaintiffs’ motion for summary judgment on the issue of whether Canada owed a duty to take steps to protect the cultural identities of Metis and Non-Status children who were placed in the care of non-Indigenous foster or adoptive parents. The Court also heard Canada’s motion, which asked for the dismissal of the Plaintiffs’ claims on the basis of limitation periods.
Justice Grammond reserved his decision after the hearing. He will be issuing his decision on a future date. At this time, we are not able to predict what the decision will be, or when the decision will be issued.
