Hollinger Canadian Publishing Holdings Co. (“HCPH”) – 24
November 8, 2010
A Retiree Audit Survey Process was approved by the Court on April 15, 2010. Over the past several months, HCPH, the Monitor and Representative Counsel have been engaged in the process of reviewing Personal Information Statements that were to be completed by plan members and submitted to the Monitor by June 18, 2010. On November 8, 2010 Justice Campbell of the Ontario Superior Court of Justice granted an Order authorizing HCPH, the Monitor and Representative Counsel to use and rely upon verified information included in Personal Information Statements that have been delivered and updated with supporting documentation up until November 12, 2010.
If you have made revisions to the Personal Information Statement you received from the court-appointed Monitor and have not yet provided the documentation to support those changes, it is very important to submit all such supporting documentation to your Representative Counsel by November 12, 2010. If you do not submit your supporting documentation on or before November 12, 2010, any unsupported information will not be accepted and prior information contained on your Personal Information Statement will be deemed accurate for the purpose of future calculations that may be necessary. You will not be able to make any changes to such information in the future. To view a copy of the Monitor’s Fifth Report, which discusses this issue in detail, please click here. On November 8, 2010 the Court also approved, subject to the consent by the Superintendent of Financial Services of Ontario, a transfer of certain assets from the HCPH Co. Pension Plan for the Employees of Newspapers Formerly Owned by Thomson Newspapers to the CanWest Pension Plan for Vancouver Island Employees, which represented the value of the defined contribution account balances for certain former members of the Thomson Plan whose employment was transferred to CanWest in 2001.
