Justice Perell released his decision on the motions heard in November 2022. Justice Perell found that the court could assume jurisdiction over each of the teams and leagues. While Justice Perell accepted the plaintiffs’ evidence that “bullying, harassment, hazing, and criminal conduct” were “pervasive” among the teams of the CHL, he dismissed the motion for certification. Instead, he provided the plaintiffs with 120 days to propose an “Individual Issues Protocol” under which the claims of individual former players would be determined.
