ORAL ORDER: IT IS HEREBY ORDERED that, in light of the decision yesterday of the Court of Appeal for Ontario to dismiss the motions for leave to appeal from the related Canadian court decision, no later than Monday, May 9, 2016, the parties shall submit short letter briefs providing their position and reasoning on whether this Court can and should now certify a direct appeal to the Court of Appeals for the Third Circuit. On April 5, 2016, Judge Stark heard the appeal by US Interests of the allocation decision of Judge Gross of May 12, 2015 and had reserved his decision. We will advise as soon as further information is available.
