Target Canada Corporation
Le 15 janvier 2015, Target Canada Corporation (« Target Canada ») et certaines de ses filiales et sociétés affilées ont obtenu protection vis-à-vis de leurs créanciers en vertu de la Loi sur les arrangements avec les créanciers des compagnies (« LACC »), conformément à une ordonnance du juge Morawetz de la Cour supérieure de justice de l’Ontario (« l’ordonnance initiale »).
Dans le cadre de l’ordonnance initiale, Koskie Minsky LLP a été désigné avocat représentant pour tous les employés dans l’instance en vertu de la LACC, et Alvarez & Marsal Canada Inc. (« le contrôleur ») a été désigné contrôleur. Target Canada débutera maintenant une cessation ordonnée de ses opérations au Canada, et chacun des 17 500 employés canadiens environ recevra un avis de cessation d’emploi. Le contrôleur aidera à superviser le processus.
Le mandat juridique de Koskie Minsky est de représenter les intérêts de tous les employés en relation avec les questions les concernant dans le cadre de l’instance en vertu de la LACC, notamment celles de la cession d’emploi et des revendications d’indemnités de départ et autres versements liés. La compagnie mère américaine de Target Canada, Target Corporation, a créé un fonds fiduciaire qui paiera pour les indemnités de départ de tous les employés de Target Canada, ce qui garantira que chaque employé de Target Canada recevra au moins 16 semaines de préavis de travail ou d’indemnités de départ (« la fiducie des employés »).

Nous sommes heureux de rapporter que la réclamation omnibus pour la perte des cartes de remise d’employés a été résolue. Sur instruction des représentants nommés par la Cour (les “Représentants”), l’avocat représentant des employés a déposé une réclamation omnibus en lien avec la perte de la remise pour les employés pendant la période d’avis. Avant le dépôt de la demande en vertu de la LACC, les employés de Target Canada avaient droit à une remise de 10% sur tous les achats en magasin (sauf en pharmacie) en sus de toute remise déjà appliquée aux produits. La réclamation avançait que les employés avaient subi une perte lorsque Target avait mis fin aux remises car ils n’étaient plus en mesure de bénéficier d’un tarif réduit sur les biens achetés en comparaison avec le public.
Après des négociations modérées par le contrôleur désigné par la Cour, nous sommes parvenus à une résolution de la réclamation omnibus. Le règlement requiert le versement d’un montant forfaitaire de 50 000 $ de Target Canada Inc. au profit exclusif d’une association caritative agréée choisie par vos Représentants. En raison du montant de ce règlement, ainsi que de la nature dispersée et transitoire de l’ancienne main-d’œuvre de Target Canada, une résolution de la réclamation utilisant l’argent de manière positive a été préférée au versement de montants nominatifs à tous les anciens employés.

Le 21 octobre 2015, la Cour a approuvé une Ordonnance de traitement des réclamations à l’encontre de la Fiducie des employés, disponible ici (en anglais uniquement).
Si vous avez déposé une réclamation à l’encontre de la Fiducie des employés, vous pouvez vous attendre à recevoir l’un des documents suivants de la part du Contrôleur :
- Lettre d’Avis de règlement : si le Contrôleur ou un représentant de Target vous a contacté(e) pour discuter de votre réclamation et considère l’objet de votre litige résolu, vous recevrez une lettre pour confirmer les modalités du règlement. Si vous acceptez ce règlement, vous n’avez aucune démarche à entreprendre.
- Avis de correction ou de rejet de la réclamation à l’encontre de la fiducie : si le Contrôleur est en désaccord avec votre réclamation à l’encontre de la Fiducie ou avec le montant de votre réclamation à l’encontre de la Fiducie, vous recevrez une lettre vous informant que celle-ci a été rejetée ou que le montant a été corrigé.
Si vous ne pensez pas que votre réclamation à l’encontre de la Fiducie a été réglée conformément aux conditions de la lettre d’Avis de règlement ou si vous êtes en désaccord avec l’Avis de correction ou de rejet de la réclamation à l’encontre de la Fiducie, vous pouvez contester ces conclusions en remettant l’un des formulaires suivants (disponibles en français prochainement) :
- Avis de contestation du règlement, avec des motifs écrits détaillant le fondement de votre contestation; ou
- Avis de contestation de la correction ou du rejet de votre réclamation à l’encontre de la Fiducie des employés, avec des motifs écrits détaillant le fondement de votre contestation.
L’Avis de contestation doit être déposé dans les 28 jours suivant la réception de votre Avis de règlement ou votre Avis de correction ou de rejet de la réclamation à l’encontre de la Fiducie. Si vous ne déposez pas votre Avis de contestation avant la date limite, il sera présumé que vous acceptez le règlement, la correction ou le rejet, et vous n’aurez plus le droit de les contester. Si vous avez besoin d’aide pour remplir l’Avis de contestation, veuillez contacter l’Avocat représentant. L’Avis de contestation doit être envoyé conformément aux instructions du formulaire, à :

Le processus de décision sera déterminé collectivement par le décideur ou la décideuse, le Contrôleur, l’Avocat représentant et l’ancien employé.

Nous continuons de recevoir des appels de Membres d’équipe qui n’ont pas encore reçu leurs Relevés d’emploi (RE) de Target. Nous avons fait tout notre possible pour traiter ce problème. On nous a informés que Target et ADP ont fait face à des complications dans le traitement des RE et sont en train de travailler à la résolution du problème. Nous comprenons votre frustration et nous encourageons les Membres d’équipe qui ont besoin de prestations d’assurance-emploi à les demander et à préciser que leur employeur n’a pas fourni de RE.

La Cour a rendu une ordonnance approuvant le processus de réclamation au moyen duquel les personnes présentant une réclamation contre les entités de Target Canada doivent déposer une Preuve de réclamation ou une Preuve de réclamation pour dirigeants et administrateurs avec le Contrôleur à 17h00 (heure de Toronto) ou plus tôt, le 31 août 2015. Le contrôleur nommé par la Cour, Alvarez & Marsal, a envoyé une lettre à tous les membres de l’équipe Target Canada le 16 juin afin de fournir des informations sur le processus de réclamation récemment approuvé. Veuillez noter que les réclamations qui découlent de votre emploi chez Target Canada mais qui ne sont pas couvertes par la Fiducie des employés doivent être présentées contre le patrimoine de Target Canada. Par exemple, si vous avez des dépenses liées à votre emploi qui n’ont pas été remboursées – une dette qui n’est pas couverte par la Fiducie des employés – vous devrez présenter votre réclamation dans le cadre du processus de réclamation pour demander à récupérer tout montant qui vous est dû.

Nous sommes en contact régulier avec le Contrôleur et les RH de Target. Il y a eu quelques retards avec l’émission des relevés d’emploi, mais ils nous ont assurés qu’ils sont au courant de cette complication et qu’ils régleront ces problèmes le plus vite possible.

INFORMATIONS RELATIVES AUX RELEVÉS D’EMPLOI
Nous avons reçu un certain nombre d’appels de membres d’équipes à propos de leurs Relevés d’emploi (RE). Veuillez noter que Target Canada collabore étroitement avec ADP pour s’assurer que soient fournies à Service Canada toutes les informations nécessaires au traitement des demandes de prestations d’assurance-emploi. ADP crée les RE et les transmet à Service Canada par voie électronique. Il faut cinq jours aux RE pour arriver auprès de Service Canada.

Cessation du régime d’avantages sociaux collectif de Sun Life
Si vous bénéficiez des avantages sociaux de SunLife en tant qu’Employé de Target, votre couverture en vertu du régime d’avantages sociaux collectif de SunLife se terminera à votre date de cessation d’emploi. Pour la plupart des employés de Target, cette date est le16 mai 2015 (le 30 mai 2015 pour les employés du Manitoba).
Veuillez noter que les avantages sociaux collectifs ne seront pas prolongés au-delà de la date de cessation d’emploi pour les employés dont les contrats de travail accordent des semaines supplémentaires de préavis ou d’indemnités de préavis au-delà du minimum légal. Si vous pensez que votre contrat de travail vous donne droit à quelque chose de supérieur ou que vous possédez une réclamation relative à cet avantage social, veuillez nous contacter pour que nous en discutions en détails.
Vous pourriez avoir le choix de conserver certains avantages sociaux à titre individuel après cessation de la couverture fournie par Target. Deux délais différents s’appliquent si vous souhaitez préserver vos avantages sociaux :
- Si vous désirez maintenir votre couverture d’assurance-vie, vous devez faire une demande directement auprès de SunLife dans les 31 jours suivant votre date de cessation d’emploi. Si vous choisissez de maintenir cette couverture individuellement, vous devez payer les coûts de ces prestations.
- Si vous désirez maintenir votre couverture d’assurances maladie et dentaire, vous devez postuler directement auprès de SunLife dans les 60 jours suivant votre date de cessation d’emploi. Si vous choisissez de maintenir cette couverture individuellement, vous devez payer les coûts de ces prestations
Veuillez noter que si vous êtes un résident du Québec, d’autres règles s’appliquent à votre cas. Vous pourriez devoir souscrire à l’assurance médicaments de la RAMQ à moins que vous ne soyez couvert(e) par une autre assurance médicaments.

Une lettre d’information des Représentants nommés par la Cour et Koskie Minsky LLP a été envoyée par courrier à tous les employés de Target Canada cette semaine pour fournir une mise à jour sur les problèmes touchant les membres d’équipe. Un formulaire d’avis de contestation est joint à la lettre d’information pour les membres d’équipe qui pensent ne pas avoir reçu le montant correct de la Fiducie des employés. La date limite pour contester les versements de la Fiducie des employés est le 31 juillet 2015. Si vous êtes en désaccord avec tout versement fiduciaire, vous devez compléter le formulaire d’avis de contestation et en envoyer une copie à Koskie Minsky LLP et au Contrôleur avant le 31 juillet 2015 au plus tard. Options pour le maintien des avantages sociaux avec SunLife
Si vous bénéficiez d’avantages sociaux via SunLife en tant qu’employé de Target, vous pourriez avoir la possibilité de maintenir certaines prestations, individuellement, après cessation de votre couverture actuelle fournie par Target. Dans la plupart des cas, les avantages sociaux collectifs via SunLife cesseront à votre date de cessation d’emploi. Pour la plupart des employés Target, cette date est le 16 mai 2015 (le 30 mai pour les employés au Manitoba).
Les employés Target qui bénéficiaient d’une couverture d’assurance-vie ou d’assurances maladie et dentaire en tant qu’employé de Target pourraient être admissibles à maintenir leurs assurances, individuellement, à partir du 16 mai (ou du 30 mai pour les employés au Manitoba).
Il y a deux dates limites applicables si vous désirez maintenir vos avantages sociaux.
Si vous désirez maintenir votre couverture d’assurance-vie, vous devez faire une demande directement auprès de SunLife dans les 31 jours suivant votre date de cessation d’emploi. Si vous choisissez de maintenir cette couverture individuellement, vous devez payer les coûts de ces prestations.
Si vous désirez maintenir votre couverture d’assurances maladie et dentaire, vous devez postuler directement auprès de SunLife dans les 60 jours suivant votre date de cessation d’emploi. Si vous choisissez de maintenir cette couverture individuellement, vous devez payer les coûts de ces prestations.
Veuillez noter que si vous êtes un résident du Québec, d’autres règles s’appliquent à votre cas. Vous pourriez être dans l’obligation de souscrire à l’assurance pharmaceutique de la RAMQ à moins que vous n’ayez une autre assurance pharmaceutique.

Au 31 mars 2015, Target Canada a annoncé la fermeture de 120 magasins avant le 8 avril 2015. Dans son 7è rapport à la Cour (en date du 24 mars 2015), le contrôleur nommé par la Cour (Alvarez and Marsal Canada Inc.) déclare qu’il est prévu que tous les magasins ferment au public dès la mi-avril 2015.
Le 30 mars 2015, la Cour a approuvé une entente relative à l’achat d’actifs entre Target Canada, Target Brands Inc. et Target Corporation (la société mère américaine) selon laquelle Target Corporation achètera une variété d’objets qui emploient ou affichent de la propriété intellectuelle (tels que les paniers d’achat et la signalisation extérieure) et paiera les coûts de retrait et de destruction de ces objets par une tierce partie.

Nous avons reçu un grand volume d’appels de membres d’équipe au sujet de questions de disponibilités et d’affectations, mais aussi d’autres problèmes quotidiens au niveau des magasins. Veuillez noter que toutes les questions et inquiétudes relatives à des sujets opérationnels quotidiens, tels que l’affectation et la disponibilité, la prise de congés maladie ou de congés légaux, doivent être présentées au Chef d’équipe cadre des Ressources humaines. De la même manière, toute question à propos de vos « heures hebdomadaires moyennes » et de votre paie au cours de la période de préavis légale devra d’abord être posée en interne à Target, via votre Chef d’équipe cadre des Ressources humaines ou à Canada.FieldHRProcess.Team@target.com.
Koskie Minsky n’est pas en position d’arbitrer ou de résoudre les conflits relatifs aux questions opérationnelles au niveau du magasin. Nous n’avons pas non plus accès aux données individuelles des membres d’équipe utilisées dans le calcul de leurs versements au cours de la période de préavis légale. Notre mandat est de représenter tous les employés de Target pour les questions les affectant dans le cadre de l’instance d’insolvabilité, notamment celles liées à la Fiducie des employés et au processus de réclamations lié.
Si possible, veuillez suivre les pratiques et procédures habituelles pour résoudre tout problème sur le lieu de travail. Si vous subissez des conséquences pour vos actions, telles que des mesures de discipline ou le licenciement, ou si l’on vous demande de signer une attestation selon laquelle vous démissionnez volontairement, n’hésitez pas à nous contacter. Conformément à l’ordonnance de représentation, un avis à tous les employés de Target Canada sera publié dans le Globe and Mail et La Presse le 17 février 2015. Concernant les versements de la Fiducie des employés aux individus en congés autorisés, Target Canada nous a informés que ceux-ci ne recevraient pas leur paiement de préavis le 13 février. Le paiement de période de préavis pour la période de paie du 25 janvier au 7 février devrait être compris dans le chèque de paie du 27 février. Veuillez noter que les individus recevant des prestations d’invalidité continueront de recevoir leurs avantages sociaux conformément aux modalités des régimes d’avantages sociaux.

Congés ou vacances autorisés
Nous avons reçu beaucoup de questions d’employés qui, avant la demande en vertu de la LACC de Target Canada du 15 janvier 2015, avait reçu l’approbation de leur chef de service pour des vacances ou autre congés. Il y a eu une certaine confusion autour de la permission de ces congés ou vacances approuvés pendant la cessation progressive des activités de Target au Canada.
Il a été dit à certains employés qu’ils devraient démissionner s’ils souhaitaient prendre ces congés ou vacances, mais également renoncer à leurs versements de licenciement. Cela est inexact.
Si vous êtes un employé de Target Canada dont la demande de vacance ou congé a été approuvée, vous aurez le droit de prendre ce congé autorisé sans pénalité. Vous n’avez pas besoin de démissionner. Votre droit à recevoir des versements de la Fiducie des employés ne sera pas affecté.

À compter du 23 janvier, Target Canada fournira une « lettre de cessation d’emploi » à certains employés lors de leur dernier jour. Cette lettre demandera à chaque employé de reconnaître avoir reçu la « lettre de cessation d’emploi » qui précise les termes et conditions de la cessation de leur emploi avec Target Canada et fournit des renseignements sur les prestations sociales et le paiement des salaires habituels au cours de la période de préavis. Cette lettre rappelle également à l’employé qu’il ou elle est encore tenu(e) à ses obligations de confidentialité, et doit rendre tout objet appartenant à Target.
Veuillez noter que Koskie Minsky LLP, en tant qu’avocat représentant des employés de Target Canada, a lu la « lettre de cessation d’emploi » et est d’avis que chaque employé peut la signer sans problème. Nous avons publié une copie de la lettre ici pour information.
