Ormrod v. Toronto Hydro-Electric Systems Ltd.
This class proceeding concerned the payment of health and dental benefits to retirees. In 1997, Etobicoke Hydro (now Toronto Hydro) advised retirees that it would no longer be paying its 50% share of premiums for health and dental plans, contrary to its previous employment policy.
A settlement of this action was reached between the parties and approved by the court on October 24, 2002. The settlement provided for an award of $420,000 to be distributed on a pro-rata basis to class members in accordance with the formula established in the Minutes of Settlement.
The class of persons the settlement represents is detailed in the Certification Order. Generally, it is comprised of all retired former employees of Etobicoke Hydro receiving coverage under the Retiree Health and Dental Plans as of June 13, 1996.
In December 2002, settlement funds were disbursed by the administrator to all eligible claimants.
