In February 2016, Koskie Minsky LLP commenced this class action on behalf of representative plaintiff, James Templin, against the Province of Ontario in respect of the Child and Parent Resource Institute (“CPRI”) in London, Ontario.
CPRI was a “Schedule 1” facility under the Developmental Services Act that housed persons labelled as developmentally challenged and delayed. It was formerly named the “Children’s Psychiatric Research Institute”.
The lawsuit alleges that the Province was negligent and breached its fiduciary duty by virtue of its operation, management, administration, supervision and control of CPRI, resulting in physical, sexual, and emotional abuse of residents, as well as other harms.
This action is now certified as a class proceeding. The proposed class encompasses “all persons who were alive as of February 22, 2014, and who were inpatients of and resided at CPRI sometime during the period from September 1, 1963 until July 1, 2011, exclusive of any time for which an individual was an inpatient and resided in the Glenhurst or Pratten 1 wards.” The case will now proceed to its resolution on the merits.
