Aviva GAI 1999 Partial Wind-up
Koskie Minsky LLP developed this website for the exclusive use of members and former members of the General Accident Indemnity Staff Pension Plan (“the Plan”) who were affected by the partial wind-up of the Plan effective 1999.
Subsequent to the declaration of the partial wind-up of the Plan, certain former members of the Plan retained Koskie Minsky LLP to negotiate an agreement to share the surplus in the Plan between Plan members and Aviva Canada Inc.
Your member representatives are pleased to advise that they have reached an agreement with Aviva Canada Inc. to share General Accident Indemnity Staff Pension Plan surplus associated with the 1999 Partial Wind-Up with plan members.
As a result of the high level of support we have received so far, we are now able to proceed to the next phase. To implement the proposal a number of regulatory filings including actuarial valuations and plan amendments must be completed. Approval of the Financial Services Commission of Ontario will also be required.
If no unanticipated obstacles arise, we are hopeful that the surplus will be distributed to members by the middle of 2010.

We are still awaiting regulatory approval of the surplus withdrawal application in this matter. We are following up regularly with the Financial Services Commission of Ontario, and will advise members through updates to this website when we receive confirmation of a decision on the application.

We are still awaiting the approval of the Superintendent of Financial Services for the Surplus Withdrawal Application, but are hopeful that this will be forthcoming shortly.
We have been advised by Aviva that pensioners and deferred vested members of the Plan will be receiving forms from Robertson Eadie & Associates in the next few weeks asking them to confirm their personal information in anticipation of the annuity purchase that will occur as soon as we get approval from FSCO to the surplus sharing agreement.

The Plan administrator filed a Surplus Withdrawal Application with the Financial Services Commission of Ontario. We hope to have a decision from the regulator regarding the sharing and distribution of surplus before the end of the summer.

On January 9, 2009, Koskie Minsky LLP, on behalf of members who have retained their services, accepted service of the Notice of Application for Surplus Withdrawal (the “Notice”) from Aviva Canada Inc.
