Hepatitis A – Vezina et al. v. Loblaws Companies Ltd. et al.

This class proceeding concerned the exposure to and risk of infection from Hepatitis A.

In August 2002, an employee of the Loblaws store located at 3671 Dundas St. W., Toronto, Ontario (the “Store”) was diagnosed with Hepatitis A. Toronto Public Health issued a notice and advised people who may have been exposed to the virus and approximately 19,200 people were vaccinated in response. It was alleged that Loblaws was negligent in exposing class members to Hepatitis A.

A settlement of this action was reached between the parties and approved on June 15, 2006. The claims process closed on October 31, 2006 and the settlement funds have been disbursed by the Settlement Administrator to all eligible claimants.

The settlement was a compromise of disputed claims and Loblaws did not admit any wrongdoing or liability. The settlement provided for an award of $150 to each class member who was exposed to the risk of infection and received an injection, as detailed in the settlement agreement. Persons infected with Hepatitis A were granted an amount decided upon through an arbitration/mediation process.
